Can you paint a logo like the halo "3" or the gears of war skull on something

and sell it? I wanted to paint this on an xbox 360 and see if i could sell it, but i'm not sure about copyrights and trademark stuff.

Technically, they are copyrighted. So it's copyright infringement. It isn't illegal to paint a copyrighted symbol, but it can be illegal to sell it. If its on, hey I have this old xbox that I painted and I'm selling it now, no company has the means or motivation to search for or come after you for a single sale.

If its oh hey I have this business painting copyrighted logos on xboxes and reselling them, they at some point find it worthwhile to do something about it.

Generally you'll get a cease and desist notice before they take any action.

Legally speaking absolutely not that is copyright infringement. However the odds of you being caught are slim.

Even if it was harmless artwork, i'm sure companies like Epic Games and Bungie wouldn't like things with their trademark on them being sold by an unauthorized retailer.
