Isn't it illegal for bungie to hold back recon armor on halo 3?

Recon armor is on your halo 3 disc (THAT YOU PURCHASED) it's just blocked. Isn't it illegal for them to hold back something you purchased. It's like paying some one to cut your grass and they only cut half and leave with your money. You can't deny I have a good point.
