Halo 3 scratched disc?

Ok so I have the standard edition of Halo 3. I ordered it online at Ebgames. So I have this ring on my disc which is a scratch. Do you think Mircrosoft or Ebgames will take it back and give me a new one?
Yeah but I'm pretty sure they are only replacing legendary editions only
