how do i get halo 3 dashboard theme?

theme is called UNITE TO FIGHT. my uncle said if you get the legendary edition of halo 3, it will download the theme to your xbox when you put the game in. mine never downloaded and i love that dashboard theme. plz help whoever knows how to get it, and tell me what i should do if its not on the legendary edition, thanks
