If I have a real halo 3 disk and my friend has a fake one?

and we play system link but are still connected to xbox LIVE can i get banned for associating with his fake game?

No.

The Xbox scanner will check his disc vs. his IP and and your disc vs. yours. If he gets banned, which isn't even a given, you won't be effected.
