Why is my Halo 3 update failing?

when Halo 3 prompts me for the update I click yes. then when it is updating (the bar doesn't move btw) a message comes up on the right side of the screen and says it failed "check your network settings" blah blah blah. it's really annoying.

what is it not doing correctly?
what is it not loading

your game is scratched or broken so send it back to the store you bought it from if its still under warranty. Or if its just your memory stick? harddrive messing up.
