No need to worry! If you are going to use the Katana gear on Xbox live then it's not like your life will exactly benefit from it like you getting real money apart from the part in where it's fun. In big matches when people play for money then it probably wouldn't be allowed and you'd probaly get banned from a tournament if you were found out. It cannot be illegal and you cannot be jailed for it (well obviously not) but if you mean illegal in halo tournaments than it's sort of a yes!

they have scanners on xbox live every second of every day - and they are most strict (most game developers have auditors checking pings etc, even pants games like shadowrun, so think of the popularity of halo3 and then think how many big brothers are watching!)
more likely than not, they will discover you a glitch like this, and can suspend or even deleat your account
